1. General Terms

By accessing or placing an order with Fresh Choice Farms Pvt. Ltd. through our website (https://freshchoicefarms.in/), mobile applications, in-store purchases, or any other communication channel (collectively, the “FCF Platform”), you agree to be bound by the Terms & Conditions below.

These Terms apply to all customers, whether ordering online, in person at our store, or through any other means of purchase. We reserve the right to update, amend, or modify these Terms at any time without prior notice. Continued use of the FCF Platform constitutes acceptance of any such changes.

2. Limitation of Liability

Under no circumstances shall Fresh Choice Farms or its representatives be liable for any direct, indirect, incidental, or consequential damages (including but not limited to loss of data, profits, or goodwill) arising out of the use or inability to use our products, services, or platform. All products are sold “as is” and “as available”, particularly given the perishable nature of fresh meat and seafood.

3. License

We grant you a limited, non-exclusive, non-transferable license to access and use the FCF Platform strictly in accordance with these Terms. Misuse, fraud, or abuse of the Platform may result in suspension or termination of your access.

4. Restrictions

  • Reproduce, modify, or commercially exploit any part of the Platform.
  • Misrepresent yourself or use our services for unlawful purposes.
  • Abuse any promotions, VIP benefits, or refund guarantees.

We reserve the right to refuse service, cancel orders, or revoke privileges at our discretion if misuse or abuse is suspected.

5. Payment

  • Payments must be made via approved methods, including Razorpay and other authorized partners.
  • You are responsible for ensuring accurate billing information.
  • Any disputes with your payment provider remain your responsibility.
  • Orders are not binding until confirmed by Fresh Choice Farms through SMS, email, or invoice.

6. Return, Refund & Satisfaction Guarantee Policy

At Fresh Choice Farms, we take pride in offering the highest quality, hygienically prepared, vacuum-sealed meat and seafood.

  • If you are unsatisfied with your order, you must notify us within 3 hours of purchase or delivery.
  • After review, we may issue a replacement, credit, or full refund at our discretion.
  • Refunds will be processed within 5–7 working days.

Important Notes: Due to the perishable nature of our products, returns after 3 hours cannot be accepted. Our 100% Satisfaction Guarantee is genuine; however, Fresh Choice Farms reserves the right to refuse refunds, replacements, or service in cases of suspected abuse or dishonesty.

7. Product Information & Availability

  • All products are subject to availability and may vary slightly from product images.
  • We comply with FSSAI standards and Indian food safety regulations, but customers must handle and store products responsibly once received.
  • Fresh Choice Farms is not liable for improper handling or storage after delivery or purchase.

8. Customer Responsibilities

  • Inspect products promptly upon delivery or purchase.
  • Refrigerate or freeze items immediately.
  • Use products before their recommended use-by or safe storage period.

9. Intellectual Property

All content, branding, packaging design, images, and digital assets on the FCF Platform are the intellectual property of Fresh Choice Farms and may not be copied, distributed, or reproduced without permission.

10. Force Majeure

Fresh Choice Farms is not liable for delays, disruptions, or cancellations caused by events beyond our control, including but not limited to natural disasters, strikes, pandemics, supply chain issues, or government restrictions.

11. Indemnification

You agree to indemnify and hold harmless Fresh Choice Farms, its employees, and affiliates from any claims, damages, or expenses arising out of your misuse of our products, services, or violation of these Terms.

12. Dispute Resolution & Governing Law

  • These Terms shall be governed by and construed under the laws of India, with jurisdiction in Lucknow, Uttar Pradesh.
  • We aim to resolve disputes amicably first. If not resolved within 60 days of written notice, disputes will be referred to binding arbitration in Lucknow in accordance with the Arbitration and Conciliation Act, 1996.

13. Right to Refuse Service

  • Fresh Choice Farms reserves the right to refuse or cancel orders at any time.
  • Restrict or terminate service to customers engaging in abusive, fraudulent, or threatening behavior.
  • Modify or withdraw promotions, VIP benefits, or guarantees if deemed to be misused.

14. Severability

If any provision of these Terms is found invalid or unenforceable, the remainder will continue in full force and effect.
